Business Services Team

Hurwitz Fine’s Business Services team regularly offers guidance and counseling to businesses and non-profit organizations affected by the COVID-19 pandemic. Our team is familiar with all aspects of the federal Paycheck Protection Program (PPP) and other loan and grant options available to assist businesses during and after the pandemic, including the Main Street Lending Program and loan programs offered by economic development agencies. Our collective experience extends far beyond loan and grant application processes; our team offers practical advice and assistance, which includes best practices for disbursement and tracking of loan proceeds for successful PPP loan forgiveness. In addition, we routinely assist businesses with determinations of whether and which of their operations are essential under Governor Andrew Cuomo’s “New York State on PAUSE” executive orders, and how to best navigate and adapt business operations in a post-COVID-19 world.

Kevin J. Zanner leads the Firm’s Business Services team and has advised business, non-profit organizations and economic development agencies for over 20 years. Evan Y. Bussiere is a partner at the firm who heads the commercial real estate and condominium & homeowner’s association practice groups and advises businesses, holding companies and developers on a diverse range of matters.

Coverage Team

The Hurwitz Fine Coverage Team represents regional, national, and international carriers in all aspects of insurance coverage and bad faith matters. We provide sophisticated advice and our coverage lawyers are widely recognized as thought leaders in their field. As COVID-19 national coordinating counsel and regional coverage panel counsel for several carriers, we are actively analyzing and cataloging Business Income legislative initiatives and litigation across the country. By following the theories presented by the policyholder bar, we are able to help our clients stay up-to date on the quickly evolving COVID-19 coverage and casualty landscape.

While it seems that every firm now has a COVID-19 “coverage” team, members of the Hurwitz Fine Coverage team focus their practice completely upon insurance policy interpretation, claims processing and procedures, and compliance with state insurance laws and regulations. The Coverage team is uniquely prepared for the myriad of COVID-19 related claims on the horizon, with expertise in both the first and third-party property and casualty claims of business interruption, general liability, directors & officers liability, employment practices liability, and errors & omissions liability, to name just a few.  The Hurwitz Fine Coverage team has been providing coverage advice and bad faith avoidance to our clients for more than 40 years.

Labor & Employment Team

Hurwitz Fine’s Labor & Employment team has actively monitored and analyzed recent changes to employment law at the federal, state, and local levels related to the current COVID-19 pandemic. We regularly counsel clients on issues related to COVID-19 leave laws, layoffs, furloughs, WARN Act notices, wage & hour issues, changes to employment policies, workplace safety, unemployment law, compliance with executive orders restricting non-essential businesses, strategic communications, and developing plans to return to “regular” workplace operations.  While the group has several decades of litigation experience, we pride ourselves in helping clients devise cost-effective strategies to avoid litigation and minimize risk.
