Lee S. Siegel, an insurance partner in Hurwitz Fine's Connecticut office, was quoted by Law360 on the impact of the West Virginia Supreme Court’s decision adopting the continuous trigger theory to long-tail claims in their Insurance Authority article, "W. Va. Continuous Trigger Ruling Will Spur Allocation Fights." Lee said that the result was expected, as it follows the majority rule; however, the real fight will come among carriers attempting to allocate multi-year claims across policies with differing language and situations where carriers have gone into receivership.
