Siegel was quoted in a recent Business Insurance article discussing the potential coverage implications of the U.S. Supreme Court’s decision in Medical Marijuana v. Horn. Lee commented that the Court’s abrogation of the “antecedent personal injury bar,” which allowed the plaintiff to advance a business damage claim arising from a personal injury, shortens the causal chain, potentially making it less challenging for a policyholder to argue that a civil RICO suit constitutes an occurrence under a commercial general liability policy.
