Ms. McCarthy leads Hurwitz Fine's Labor & Employment Practice Group and is also a litigator in the firm's Premises Liability, Retail & Hospitality, and Products Liability practice groups. She counsels and defends businesses of all sizes, municipalities, and school districts in a broad range of employment and civil litigation matters, advising employers on compliance issues, conducting workplace investigations, and defending clients before the New York State Division of Human Rights, the EEOC, and in state and federal courts.

As an experienced litigator, Ms. McCarthy defends civil matters from inception through trial and has experience writing and arguing appeals. She provides strategic guidance that helps clients effectively manage risk and achieve successful outcomes.

Outside of her traditional legal practice, Ms. McCarthy regularly speaks and presents on a variety of trending legal topics in employment and civil rights law. Her most recent speaking engagements have been about the shifting Diversity, Equity, and Inclusion landscape in the workplace, anti-discrimination law, and litigation trends and strategies impacting those in the retail and hospitality industry.

Currently, Ms. McCarthy serves on the firm’s Diversity & Inclusion Committee, co-chairs the Women’s Forum, and coordinates the firm's mentorship program. She completed the Buffalo Niagara Partnership’s Diversity & Inclusion Academy program and the Amherst Chamber of Commerce Emerging Business Leaders program. She currently participates in the Chamber’s ProNet networking program.

Ms. McCarthy is a member of the New York State Bar Association, as well as the Women’s Bar Association of New York (WBASNY) and the Bar Association of Erie County (BAEC).  She currently serves as the Secretary of the Minority Bar Foundation of WNY and is on the Board of Directors for the UB Law Alumni Association. Ms. McCarthy is also a member of the BAEC's Equity Audit Committee, Vice-Chair of the BAEC's LGBTQIA+ Committee, and serves on the board of GLYS Western New York Inc. and the Pride Center of WNY.

Ms. McCarthy is a proud Past President of WBASNY’s Western New York Chapter. She also spent six years working as a co-chair of WBASNY’s statewide legislation committee, which allowed her the opportunity to gain substantial experience in lobbying and legislative advocacy.

Recently, Ms. McCarthy was accepted into the National Retail and Restaurant Defense Association (NRRDA), a prestigious organization dedicated to advancing the defense of retail and hospitality-related claims—a significant recognition of her professional excellence and industry leadership.

Before joining Hurwitz Fine, Ms. McCarthy served as Assistant Field Counsel for a large national insurance carrier. She earned dual Bachelor of Arts degrees in English Literature and Theatre from SUNY Geneseo. She received her Juris Doctor degree cum laude from the University at Buffalo School of Law.
