By drawing on an illustrative array of reported decisions and “real world” scenarios, this program examines the “line drawing” determination courts undertake to resolve disputes over the discoverability and admissibility of claim file materials to differentiate between privileged materials prepared in “anticipation of litigation” and non-privileged materials generated in the “ordinary course” of the insurer’s claims handling obligations.
