While elevator and escalator incidents can occur for many reasons, in litigation, most are categorized into either products liability or premises liability. In products liability, manufacturers and downstream sellers may be liable for designing, manufacturing, or selling a defective elevator/escalator. In premises liability, property owners and maintenance providers may be liable for failing to safely maintain the elevator/escalator after it is manufactured and sold. This course identifies initial steps to assess defects and negligence, presenting a framework for navigating elevator/escalator accident litigation, including potential claims and defenses.
