Hurwitz Fine Senior Member Dan D. Kohane was quoted in a July 1st New York Law Journal article entitled, "'The 51% Blindfold': Litigators Prep for Battle Over Telling Juries About New Fault Caps."
With the adoption of the tort reform legislation discussed by Dan and Brigette R. Whitmore in a June 8th NYLJ article on the statute effective for actions commenced on or after May 26, 2026, the courts will begin to consider whether trial attorneys can discuss, with juries, the impact of those changes in trials impacted by the statute. Dan was asked to comment on the arguments that are likely to be raised by lawyers on both sides.
