On December 16, 2022, Hurwitz Fine attorneys Scott D. Kagan and V. Christopher Potenza were published in the New York State Bar Association's Torts, Insurance & Compensation Law Section Journal for their comprehensive article, “The Ups and Downs of Elevator and Escalator Litigation.”
In the article, Scott and Chris provide insight on elevator and escalator incidents, and the reasons why they occur. Such incidents may result in litigation that is often complex and expensive to litigate on theories of both product defect and negligent maintenance. Intricate mechanical and digital components will require expert consultation and knowledge on issues of both design and proper maintenance. Understanding these issues from the onset can help reduce the complexity and cost of litigation.
