The recent legalization of recreational marijuana for people over the age of 21 in New York poses unique risks to construction companies. Contractors must now balance jobsite safety with workers’ legal rights, while adhering to customer requirements and managing risk. The law specifies what employers can and cannot do with respect to employee marijuana use.
