Frequently involved in matters pertaining to managed care, governance, employment relations, financial and accounting audits, and hospital and university affiliations, Hurwitz & Fine, P.C. has considerable experience with the complex interrelation among private practice, third party payers, hospital affiliation, and university affiliation.
Our attorneys have consulted on various matters of particular relevance to those business operating in the medical field including practice acquisitions and sales, organization structures, staff and physician benefits planning, joint ventures, medical staff matters, medical records, credentialing issues, physician recruitment, community service planning, tax planning, retirement planning and civil controversy work.
The firm has also represented clients before the Internal Revenue Service and New York State Department of Taxation and Finance on audit matters pertaining to income, sales and corporation franchise tax and advised employers on issues of New York State Disability Benefits Law, federal COBRA continuation rights, termination/substitution of group health/accident insurance, Family Medical and Leave Act rights.
In the course of its representation of individual practitioners, groups, professional corporations and university faculty practice plans in their professional and business activities, the firm has had frequent occasion to prepare many legal documents, including employment and shareholder agreements, financing arrangements and equipment and commercial leases, and to negotiate billing arrangements with service providers.
The firm is particularly sensitive to evolving legal issues affecting the health care community, including health care cost containment strategies, hospital credentialing and grievance (due process) issues, physician self-referrals, and anti-trust matters, as a result of its representation of two major community hospital medical staffs and the reworking of those medical staff by-laws and rules and regulations.
